RHINO LININGS CORPORATION WARRANTY
Rhino Linings Corporation (referred to herein as “Rhino”) warrants that for a period of six months from the date of shipment from Rhino, the product, equipment and parts (collectively referred to herein as “Product”) will be, under normal use, free from defects in material and workmanship provided, however, that this warranty does not cover, and Rhino shall not be liable for, any malfunction, damage or wear caused by faulty installation, misapplication, abrasion, corrosion, inadequate or improper maintenance, negligence, accident, tampering, substitution of non-Rhino component parts or products, improper storage, or other misuse. All warranty claims must be made in accordance with “Warranty Claims” below.
Rhino agrees to assign to Dealer whatever rights Rhino may have under any warranty, expressed or implied, of any supplier or manufacturer or Product sold by Rhino but not manufactured by Rhino, to the extent assignable.
Rhino’s entire liability and Dealer’s exclusive remedy under this warranty will be to repair, or at Rhino’s option, to replace without charge, any Product which Rhino determines to be defective within the scope of this warranty. In the event Rhino is unable to repair or replace a defective Product within a reasonable time after receipt, Rhino shall credit Dealer with the original purchase price of the defective Product.
The foregoing warranty is in lieu of any other warranty, expressed or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
This warranty may not be modified except in writing by a corporate officer of Rhino and must be specifically designated as “changes to warranty.” In the event of any conflict between this warranty dated October 1, 1995 and any other agreement or representation between Rhino and Dealer, the terms of this Warranty shall be deemed to control.
Warranty Claims: Return Material Authorization
In order to make a warranty claim, Dealer must comply with the procedures stated herein, which are designed to protect the rights both of Rhino and Dealer. A Return Material Authorization (RMA) number must be obtained from Rhino’s Customer Service Department for the return of any Rhino equipment, parts or product. Equipment, parts or product returned to Rhino without proper authorization will be returned to Dealer at Dealer’s expense.
In order to obtain an RMA number for a warranty claim for equipment, parts or product, Dealer must contact Rhino’s Customer Service Department to determine whether Dealer should ship the equipment, parts or product to Rhino, or whether Rhino will make an inspection at Dealer’s site. If shipment is required, an RMA number will be issued and must be placed outside of the shipment being sent to Rhino, as well as on any accompanying documents returning with the item. Following inspection of the equipment and parts, Rhino will determine whether there is a defect covered by warranty. If there is a defect covered by warranty, Rhino will pay for the shipping of the return and/or replacement. If Rhino determines that the equipment, parts or product are not covered under the warranty, Dealer will be responsible for all shipping charges.
In an effort to offer the most advanced spray systems and up-to-date marketing tools possible, items from this catalog may be added, deleted, or substituted without prior notice. Equipment and prices are subject to change without notice.
